PTO Application

Permit to Operate (State):

  • A Permit to Operate (PTO) provides emission limitations and requirements enforcing state, federal and local regulations and Ohio EPA guidance for existing emissions units that are already operating. There are four types of PTOs:
  • A State PTO is a permit issued after obtaining a PTI and after the source is constructed and is operating. A State PTO is also issued to sources installed prior to 1974. These sources are not required to obtain a PTI; therefore, there would be no PTI on record. A State PTO is issued to each emissions unit within a facility, where the emissions unit and/or facility do not exceed the requirement criteria for the Title V Permit program.
  • A Title V Permit is a federally enforceable permit to operate for major sources or facilities. A single Title V permit is typically issued for an entire facility and identifies all emissions units at the facility.
  • A Federally Enforceable State Operating Permit (FESOP) is a permit issued by the State to a major source. The FESOP contains limitations to keep the facility below the major source thresholds and avoid Title V and/or Prevention of Significant Deterioration (PSD) permitting. Usually, a single FESOP addresses multiple emissions units at a facility.
  • Registration Status is a condition that may be imposed on small sources by Ohio EPA as an alternative to issuing a State PTO. Registration status remains in effect until the Director of the Ohio EPA decides otherwise and notifies the facility. There are no PTO fees required for registration status.
